Terms & Conditions

These Terms and Conditions (“Terms”) govern all services provided by Earthscapes LLP (“Contractor,” “we,” “us,” or “our”). By approving an estimate, scheduling services, or allowing work to begin, the client (“Client,” “you”) agrees to the following terms.

Estimates & Scope of Work

All estimates are based on visible conditions at the time of evaluation. Any changes to the agreed scope of work must be approved in writing and may result in additional costs. Unforeseen site conditions, including underground obstructions or soil conditions, may require adjustments to pricing or timeline.

Deposits & Payments

A deposit is required to secure scheduling. Payment terms, including deposit amount and final balance, will be outlined in the project agreement or invoice. Late payments may result in delays, work stoppage, or additional fees.

Scheduling & Delays

Project timelines are estimates only and may be impacted by weather, material availability, inspections, or unforeseen conditions. Earthscapes LLP is not responsible for delays beyond our control.

Site Access & Safety

Client agrees to provide safe, clear, and unobstructed access to all work areas. Pets must be secured, and unauthorized individuals must remain clear of active work zones. Construction areas may contain debris, equipment, and uneven surfaces.

Utilities & Property Conditions

Client is solely responsible for identifying and marking all private utilities, including irrigation, private electrical, gas, lighting, and data lines. Earthscapes LLP will coordinate public utility locates through Colorado 811. We are not responsible for damage to unmarked utilities, underground obstructions, or pre-existing conditions.

Damage Disclaimer

Earthscapes LLP is not responsible for damage to landscaping, hardscape, irrigation, concrete, or structures caused by pre-existing conditions, hidden obstacles, weather events, soil movement, or normal wear and tear associated with construction activities.

Cancellations

Cancellations or rescheduling require a minimum of 48 hours’ notice. Deposits may be non-refundable once materials are ordered or work is scheduled.

Warranties

Any workmanship or plant warranties apply only where expressly stated in writing and are subject to proper care and maintenance by the Client.

Limitation of Liability

Earthscapes LLP shall not be liable for indirect, incidental, or consequential damages. Liability, if any, shall not exceed the total amount paid for services rendered.

Governing Law

These Terms shall be governed by the laws of the State of Colorado.

Digital Acceptance & Electronic Signatures

Client acknowledges and agrees that approval of estimates, proposals, invoices, or scheduling through electronic means—including but not limited to online acceptance, email confirmation, text message approval, or Jobber’s digital approval tools—constitutes a legally binding agreement. Electronic signatures, digital approvals, and electronic communications shall have the same force and effect as handwritten signatures. By providing digital acceptance, Client authorizes Earthscapes LLP to proceed with the agreed scope of work and acknowledges acceptance of these Terms and Conditions.
